iMBDS - Terms and Conditions 1. Introduction Welcome to the Integrated Manila Bayanihan Database System (iMBDS). By accessing or using our platform, you agree to adhere to and be bound by the following Terms and Conditions. Please read them carefully, as they govern your use of the IMBDS. 2. Definitions "User": Refers to any individual or organization accessing or utilizing iMBDS services. "IMBDS": Refers to the Integrated Manila Bayanihan Database System, which serves to facilitate collaboration, coordination, and data management among government agencies, LGUs, DENR employees, and other stakeholders. "Services": Refers to the functionality and features provided through iMBDS, including data collection, reporting, and collaboration tools. "Content": Refers to any data, information, text, graphics, or other material provided or uploaded through the platform. 3. Eligibility You must be employed by a government office under the mandamus agencies, LGUs, or be a DENR employee to use this platform. By accessing and using iMBDS, you confirm that you meet these eligibility requirements, are of legal age, and possess the legal capacity to enter into a binding contract. 4. Registration and User Accounts • To access certain features of iMBDS, you may be required to create an account and provide accurate and current information. • You are responsible for maintaining the confidentiality of your account credentials and for any activities that occur under your account. • You agree to notify iMBDS immediately of any unauthorized use of your account or any other breach of security. 5. Use of IMBDS • iMBDS is intended for use by authorized personnel of mandamus agencies, LGUs, and DENR employees for the purpose of data management and collaboration in accordance with the platform's objectives. • You agree to use iMBDS only for lawful purposes and in compliance with applicable laws, regulations, and these Terms and Conditions. • You are prohibited from uploading or distributing content that is illegal, harmful, defamatory, or violates the rights of others. 6. Intellectual Property Rights • All intellectual property rights related to iMBDS, including but not limited to software, design, trademarks, and content, are owned or licensed by iMBDS. • Users may not reproduce, modify, distribute, or commercially exploit any part of the platform without the prior written consent of iMBDS. 7. Data Collection and Privacy • iMBDS collects, processes, and stores personal and organizational data as necessary to fulfill its intended purpose. By using the platform, you agree to the collection and use of this data in accordance with our Privacy Policy. • Users must ensure that any data submitted to the platform complies with applicable data protection laws, including the Data Privacy Act of 2012 (Republic Act No. 10173). 8. User Content You retain ownership of any content you upload or submit to iMBDS. By submitting content, you grant iMBDS a non-exclusive, royalty-free license to use, store, display, and distribute such content as necessary to provide the platform's services. iMBDS reserves the right to remove any content that violates these Terms and Conditions or is otherwise deemed inappropriate. 9. Limitation of Liability • iMBDS is provided on an "as-is" and "as-available" basis, and we do not guarantee that the platform will be free from interruptions, errors, or defects. • To the fullest extent permitted by law, iMBDS disclaims any liability for any direct, indirect, incidental, or consequential damages arising from your use of the platform. 10. Suspension and Termination • iMBDS reserves the right to suspend or terminate access to the platform at any time, with or without notice, for any violation of these Terms and Conditions or for any other reason deemed appropriate by iMBDS. • Upon termination, your access to the platform will cease immediately, and any licenses granted to you will be revoked. 11. Amendments to the Terms • iMBDS reserves the right to modify or amend these Terms and Conditions at any time. Any changes will be communicated to you via email or through a notice on the platform. • Continued use of the platform following any changes constitutes your acceptance of the revised Terms and Conditions. 12. Governing Law These Terms and Conditions are governed by and construed in accordance with the laws of the Philippines. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts located in Manila, Philippines. 13.
